<p>This E-Sign Disclosure and Consent Notice (“<u>Notice</u>”) applies to all Communications, as defined below, for services provided by or on behalf of Trader Interactive, LLC, a Florida limited liability company d/b/a RVTrader Rentals or such other trade name(s) as the company may from time to time utilize in connection with its vehicle-rental business operations (“<u>Trader</u>”, “<u>our</u>”, “<u>us</u>” or “<u>we</u>”), or by third parties using the Trader Platform (as further described below, the “<u>Platform</u>”, and such third parties, “<u>Platform Users</u>”). Platform Users include parties providing services to Platform Users or owners or renters of any vehicle that is listed on the Platform (each, a “vehicle”). Under this Notice, Communications you receive in electronic form from us or Platform Users will be considered “in writing”. “<u>Platform</u>” means the vehicle rental platform operated by Trader that permits Platform Users to consummate transactions involving the rental of certain vehicles.</p><p>By using Trader electronic and online services, including, without limitation, listing a vehicle for rental on the Platform or renting a vehicle to or from another person or entity over the Platform (collectively, “<u>Electronic Services</u>”), you hereby (a) agree that Trader or Platform Users may provide information to you electronically and, furthermore, that Trader or Platform Users may use electronic records and signatures in their relationship with you, including, without limitation, to evidence your agreement and acceptance of any Rental Agreement that sets forth the terms of the rental of a vehicle consummated over the Platform; (b) confirm that you have the hardware and software described below, that you are able to receive and review electronic records and that you have an active email account; and (c) consent to the terms of this Notice. If you choose not to consent to this Notice or you withdraw your consent, you will be restricted from using our Electronic Services.</p><h2>COVERED COMMUNICATIONS</h2><p>Communications covered by this Notice (“<u>Communications</u>”) may include, without limitation, disclosures and communications that Trader or Platform Users will or may provide to you regarding Electronic Services such as: (i) terms and conditions, privacy statements, Rental Agreements, Booking Forms, Owner’s Agreements, or notices and any changes thereto; (ii) payment terms and disclosures, transaction receipts and confirmations; and (iii) customer service communications (such as claims of error communications).</p><h2>METHODS OF PROVIDING COMMUNICATIONS</h2><p>Trader or Platform Users may provide Communications to you by email, text message, or by making them accessible on the Platform, other Trader websites, mobile applications, mobile websites and/or data management systems (including via “hyperlinks” provided online and in e-mails). Communications will be provided online and viewable using browser software or PDF files.</p><h2>HARDWARE AND SOFTWARE REQUIREMENTS</h2><p>To access and retain electronic Communications, you must have:</p><ul><li>A valid email address;</li><li>A computer, mobile phone, tablet or similar device with Internet access and current browser software and computer software that is capable of receiving, accessing, displaying, and either printing or storing Communications received from us in electronic form; and</li><li>Sufficient storage space to save Communications (whether presented online, in e-mails or PDF) or the ability to print Communications.</li></ul><p>We may in our discretion request that you respond to an email to demonstrate you are able to receive these Communications.</p><h2>HOW TO WITHDRAW YOUR CONSENT</h2><p>You may withdraw your consent to receive electronic Communications under this Notice by writing to us at privacy@traderinteractive.com or mailing Trader Interactive, Attn: Legal Department, 999 Waterside Drive, Norfolk, VA 23510. Your withdrawal of consent will cancel your agreement to receive electronic Communications and, therefore, your ability to use our Electronic Services.</p><h2>UPDATING YOUR CONTACT INFORMATION</h2><p>It is your responsibility to keep your primary email address current so that Trader and Platform Users can communicate with you electronically. You understand and agree that if Trader or a Platform User sends you a Communication but you do not receive it because your primary email address on file is incorrect, out of date or blocked by your service provider, or if you are otherwise unable to receive electronic Communications, Trader or the Platform User, as applicable, will be deemed to have provided the Communication to you; however, we may deem your account inactive. You may not be able to transact using our Electronic Services until we receive a valid, working primary email address from you.</p><p>You can update your primary email address in your online profile, writing to us at <a href="mailto:privacy@traderinteractive.com">privacy@traderinteractive.com</a> or mailing Trader Interactive, Attn: Legal Department, 999 Waterside Drive, Norfolk, VA 23510.</p><h2>FEDERAL LAW; INTENT</h2><p>You acknowledge and agree that your consent to receive electronic Communications is being provided in connection with a transaction affecting interstate commerce that is subject to the federal Electronic Signatures in Global and National Commerce Act (the “<u>Act</u>”), and that you, we, and all Platform Users intend that the Act apply to the fullest extent possible to validate the foregoing parties’ ability to conduct business by electronic means.</p><h2>TERMINATION/CHANGES</h2><p>We reserve the right, in our sole discretion, to discontinue providing you with electronic Communications and/or to terminate or change the terms and conditions on which we provide Communications to you. We will provide you with notice of any such termination or change as required by law.</p>
